City of Mill Creek Policy Statement

The City of Mill Creek is committed to creating an inclusive and welcoming environment that values and respects all individuals. The City assures that no person shall on the grounds of race, color, national origin, or sex, as provided by Title VI of the Civil Rights Act of 1964 as amended, and the Civil Rights Restoration Act of 1987 be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any of its federally funded programs and activities.

The City of Mill Creek also ensures every effort will be made to ensure non-discrimination in all of its programs and activities, whether those programs and activities are federally funded or not.

In the event the City of Mill Creek distributes federal funds to a sub-recipient, the City of Mill Creek will include Title VI language in all written agreements and will monitor for compliance.

Who can file a Title VI Complaint against the City of Mill Creek?

Any person who believes he or she, individually, as a member of any specific class, or in connection with any disadvantaged business enterprise, has been subjected to discrimination prohibited by the Title VI of the Civil Rights Act of 1964 as amended, and the Civil Rights Restoration Act of 1987 under any of the City’s federally funded programs and activities.

How to File a Complaint Against the City of Mill Creek?

Prior to filing a formal Title VI complaint, you are encouraged to work directly with the City to resolve the issue.

A formal Title VI complaint must be filed within 180 days of the date of the alleged discrimination. The complaint must contain a narrative description of the allegation(s) in sufficient detail to enable the Title VI Coordinator to understand what occurred, when it occurred, and the basis of the alleged discrimination complaint (e.g. race, color, national origin, etc.). The complaint must include all contact information for the complainant including name, address and telephone number, as well as all contact information for all witnesses or individuals with relevant knowledge.

The complaint must be dated and signed by the complainant(s) or his/her/their representative.

What Happens When a Person Files a Complaint?

When a complaint is received, the City will provide written acknowledgement to the complaint within 10 days and provide proposed action to be taken to process complaint. The City will advise the Washington State Department of Transportation (WSDOT) of the complaint within ten calendar days of receipt of the complaint.

If a complaint is deemed incomplete in their submission, additional information will be requested, and the complainant will be provided 60 calendar days to submit the required information. Failure to do so may be considered good cause for a determination of no investigative merit.

What is the Investigation Process?

If the complaint has investigative merit, the Title VI Coordinator will assign an investigator. Within 60 calendar days, an investigation of the complaint will be conducted based on the information obtained, and the Title VI Coordinator will make a

recommendation to the City Manager. The complaint should be resolved by informal means wherever possible. Such informal attempts and the results will be summarized in the report of findings.

Within 90 calendars days from receipt of the complete complaint, the City Manager will notify the complainant in writing of the final decision reached, including the proposed disposition of the matter. If the decision is not to be investigated, the notification shall specifically state the reason for the decision. The Title VI Coordinator will also provide WSDOT with a copy of the decision and summary of findings.

What If I Don’t Agree with the City Manager’s Letter of Resolution?

The notification of final decision will advise the Complainant of his or her appeal rights with WSDOT and the United States Department of Transportation (USDOT) if you are not satisfied with the decision by the City.

Accommodation Request Form

The City of Mill Creek welcomes an accommodation request for a translator, barrier removal, etc., or documents/materials in alternate formats in any letter, email, newsletter or website used to announce, invite or promote a City program, service or activity. If this information is not provided, please contact the City's Title VI Coordinator to make your request. Please make requests for accommodation at meetings or events as soon as possible or no later than 48 hours prior to the scheduled event. 

Requests for accommodation at a City meeting/event or materials in alternate formats should include:
•    The requestor's name, address, email and telephone number (if any)
•    A description and location of the program, service or activity where the accommodation is being requested
•    A brief description of why the accommodation is needed
•    For materials in alternate formats: All of the above and what type of format is desired

The City Title VI Coordinator or the responsible City Department will respond to the request in advance of a scheduled meeting or event. If the response does not satisfactorily resolve the issue, the requestor may file a formal grievance with the City. All requests for accommodations and alternate formats will be kept on file for at least three years.
